Why is Donald Trump back in court against E Jean Carroll?

Donald Trump has lost his latest appeal of the gag order imposed on him by Judge Tanya Chutkan in the federal election interference criminal case brought against him by Special Counsel Jack Smith.

A three-judge panel had previously upheld the gag order that forbids the former president from talking about witnesses and court staff, and 11 judges from the DC Circuit Court of Appeal have now declined to look further at the matter.

Mr Trump could still try and bring the issue before the Supreme Court.

Meanwhile, the former president resumed online attacks against E Jean Carroll after the latest instalment of her defamation trial against him in New York had to be postponed on Monday over concerns about exposure to Covid-19 in both the jury and the defence team, thwarting his plans to testify.

Mr Trump’s attorney Alina Habba asked for the court to resume on Wednesday, one day after the New Hampshire presidential primary election, a request that Ms Carroll’s attorneys opposed.

US district judge Lewis Kaplan duly agreed to postpone the hearing until Thursday morning, allowing Mr Trump to return early to his campaigning in the Granite State.

Many Republican lawmakers said they would “support” but not “endorse” Mr Trump in 2016 because he won a more split field that allowed him to clinch the nomination without a majority. That meant they did not know the depth of his support within the GOP electorate. Many assumed he would lose the general election. As a result, they did not want to tie themselves to someone who might damage their own prospects.

Those fears no longer exist. Mr Trump cleared a majority in Iowa and could potentially do so in New Hampshire. Most Republican voters have an almost fanatical devotion to Mr Trump and the fact he won the presidency once, narrowly lost it in 2020 and now largely leads Mr Biden in many polls in multiple swing states means he feels like a much safer bet.

One clip started mid-sentence, showing Mr Trump speaking in New Hampshire: “Which is incapable of solvin’ even the sollest… smallest problem. The simplest of problems we can no longer solve.”

Could Fani Willis be removed from prosecuting Trump?

Accusations that Fulton County District Attorney Fani Willis had an inappropriate relationship with a special prosecutor she hired to seek convictions of Donald Trump and others for interfering in Georgia’s 2020 election have led to renewed calls to remove Willis from the case.

Willis has defended her hiring of Nathan Wade, who has little prosecutorial experience and has not directly denied a romantic relationship. The allegations were first made public in a motion filed earlier this month by defence attorney Ashleigh Merchant, who represents former Trump campaign staffer and White House aide Michael Roman.

Merchant alleges that Willis’ office paid Wade large sums and that Willis improperly benefited when Wade then paid for the two of them to go on vacations. Merchant has not offered any proof of the alleged relationship. But a filing last week by Wade’s wife in their divorce case includes credit card records that show that Wade bought plane tickets for Willis to travel with him to Miami and San Francisco.

Willis, an elected Democrat, has shown no signs of stepping down, but there are ways she could be removed. Here’s a look at some options:

A consortium of media organisations including wire services Reuters and the Associated Press, as well as The Washington Post and The New York Times, is renewing a request to a federal court in Washington DC to be allowed to livestream Donald Trump’s election interference case when it gets to trial.

The group of news outlets points to an “extraordinary exchange” during the live-streamed appeals court hearing where Mr Trump’s lawyer said a president could legally assassinate his rival.

Carroll v Trump postponed another day

The second defamation trial of Donald Trump brought against him by writer E Jean Carroll will now resume on Thursday and not Wednesday as previously scheduled.

Judge Lewis Kaplan will continue presiding over the case in Lower Manhattan at 9.30am on 25 January.

Canada‘s government is preparing for the possibility that Donald Trump could reach the White House again and the “uncertainty” that would bring, Prime Minister Justin Trudeau said Tuesday at a Cabinet retreat.

Trudeau said that Trump “represents uncertainty. We don’t know exactly what he is going to do,” but he said that his government was able to manage Trump previously by showing that Canada and the U.S. can create economic growth on both sides of the border.
